Terms of Service for Flow by Unsung Studios

1. Acceptance of Terms

By accessing or using Flow ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Flow is a creative wellness platform that uses AI-assisted songwriting to support emotional expression, self-reflection, and personal growth. The Service includes:

• Interactive conversations with AI for creative guidance
• Collaborative lyric writing tools
• AI-generated music creation using third-party services
• Personal session history and progress tracking

3. User Eligibility and Responsibilities

Age Requirements

You must be at least 18 years old to use Flow. Users under 18 may only use the Service with explicit consent and supervision from a parent, legal guardian or qualified mental health professional.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Important Limitations and Disclaimers

Not Professional Therapy

Flow is not a substitute for professional mental health treatment. The Service:

• Is not provided by licensed mental health professionals
• Does not diagnose or treat mental health conditions
• Should not replace therapy, counseling, or medical treatment
• Is not appropriate for crisis situations or immediate mental health emergencies

5. Intellectual Property and Content

Your Content

You retain ownership of the lyrics, ideas, and creative content you generate using Flow. By using the Service, you grant us a limited license to process, store, and analyze your content solely to provide the Service.

Ownership of Generated Music

Your Ownership: As between you and Unsung Studios, and to the extent permitted by applicable law, you own all rights in the output you generate through our Services (“Generated Content”) based on your Input Content and your specific prompts. Music you create using Flow is yours. You own the audio files you generate and are free to use them in any way you choose—whether that means saving them, sharing them, or incorporating them into your personal or creative projects. Unsung Studios does not claim ownership of your generated music.

• Our Limited Rights: You grant Unsung Studios a limited, worldwide, non-exclusive, royalty-free license to host, store, and display your Generated Content solely for the purpose of providing the Services to you (e.g., allowing you to access and download your generated files).
• Your Responsibility for Generated Content: You are solely responsible for the Generated Content you create and how you use it. This includes ensuring that your use of the Generated Content complies with all applicable laws, regulations, and third-party rights (e.g., copyright, trademark, publicity rights, privacy rights).

6. Third-Party Services

Certain features of Flow make use of third-party services including:

• Azure AI Foundry for conversational AI and text processing
• MusicGPT API for music generation
• Auth0 and Google for secure authentication

Your use of those features may be subject to the third party’s terms and privacy policy. We are not responsible for third-party services and disclaim all liability arising from their acts or omissions.

7. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. Key points:

• All conversations and content are encrypted
• We do not sell your personal data
• We do not train AI models on your personal content
• Data shared with third-party services is minimized and is anonymized when possible

8. Prohibited Uses

You agree not to use Flow to:

• Violate any applicable laws or regulations
• Create content that is harmful, threatening, or harassing
• Attempt to reverse engineer or compromise the Service
• Share account credentials with others
• Use the Service for commercial purposes without authorization
• Generate content that infringes on others' intellectual property rights

9. Service Availability and Changes

We strive to maintain reliable service but cannot guarantee continuous availability. We reserve the right to:

• Modify, suspend, or discontinue the Service
• Update these Terms with advance notification
• Implement new features or remove existing ones

10. Limitation of Liability

To the fullest extent permitted by law, Unsung Studios and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Flow. Our total liability shall not exceed the amount you paid for the Service in the preceding 12 months.

11. Termination

You may terminate your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or for other legitimate business reasons. Upon termination, your right to use the Service ceases immediately.

12. Governing Law and Disputes

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13. Changes to Terms

We may update these Terms periodically to reflect changes in our Service or legal requirements. We will notify you of material changes and update the "Effective Date" above. Continued use of the Service after changes constitutes acceptance of the new Terms.
